Noteworthy Achievements From 2023

On June 28, 2023, we prevailed at jury trial in US District Court for breach of contract and breach of warranty involving medical blood and tissue assay machine in Synergy v. Abbott.

On April 12, 2022, Grant of US Patent No. 11299389, “Saddle with Interface Having Passively Morphing Elements and Methods of Use”

On January 11, 2022, the U.S. District Court for the Southern District of California, found trademark infringers in contempt of injunction order. See H.I.S.C., Inc. v. Franmar.

Noteworthy Achievements From 2021

On December 1, 2021, the U.S. Ninth Circuit affirmed award of attorneys’ fees based on an exceptional case under Octane Fitness, in H.I.S.C. v. Rajanayagan, 2021 WL 5632505.

On October 23, 2021, David R. Flyer was welcomed into the American Board of Trial Advocates (ABOTA)

On October 8, 2021, prevailed on appeal reversing award of anti-SLAPP sanctions against clients in Nielsen (cross-complainant) v. MacPherson (cross-defendant) (4th District Div 3 10/8/21) 2021 WL 4704890

On April 20, 2021, the Court of Appeal affirmed grant of summary judgment on behalf of our client, a charitable organization, and against four former directors based on breach of fiduciary duty. See Disability Services Corporation v Grant, 2021 WL 1540565.

On June 23, 2020, prevailed on appeal affirming judgment entered after jury verdict in H.I.S.C. v. Rajanayagan, (9th Circuit 2020) 810 Fed.Appx. 560

On June 20, 2020, the Court of Appeal granted our client control of the family estate following death of her ex-husband and probate court challenge by ex-husband’s heir based on IRMO Hilke, see IRMO Hong-Lien T. And Huu Pham, 2020 WL 2895447

Grant of US Patent No. 10569410 on February 25, 2020 “Device for Stabilizing and Securing Testing Tubes in Cast-in-Drilled-Hole Piles”

Grant of US Patent No. 10220503 on March 5, 2019 ” Device and Method for Stabilizing and Securing Testing Tubes in Cast-in-Drilled-Hole Piles”

Noteworthy Achievements From 2018:

Jury verdict in USDC Southern District, HISC v. Franmar, Case No. 16-cv-480-BEN-WVG entered in favor of our client, plaintiff, for trade dress infringement in the amount of $265,977.00.

Obtained patent grant for clients: U.S. Patent No. D814650 “Rehabilitation Device for the Ear.”

Prevailed at trial on will contest over claim of lost will.

Noteworthy Achievements From 2017:

Obtained two patent grants for clients: U.S. Patent No. 9,803,946 “Flash, Noise and Smoke Suppression Device”; and U.S. Patent No. 9,725,983 “Electromagnetic Oil Pipe Plugger.”

Prevailed on appeal in Schueneman v. Lively, 4th District, 2017 WL 2609552, reversing summary judgment and allowing client to receive substantial settlement.

Noteworthy Achievements From 2016:

Prevailed on six-day jury trial for breach of contract in Los Angeles Superior Court. Then awarded just under $200,000.00 in attorneys’ fees.

Obtained three patent grants for clients: US Patent No. 9,469,959 “Full Displacement Pile Tip and Method for Use”; US Patent No. 9,433,825, “Swimming Aid Device”; and
US Patent No. D769210, “Design for Media Terminal Housing.”

Settled licensing case for seven figures.

Obtained allowances from USPTO on two non-provisional patent applications

Noteworthy Achievements From 2015:

Settlement in six figures of wrongful death motor vehicle collision at policy limits.

Settlement in six figures of personal injury vehicle collision, exhausting defendant’s policy, and against underinsured motorist policy.

Successful defense after contested court hearing of claim for domestic violence.

Successful defense against claim for negligent servicing of automatic fire extinguisher system.

Successful defense against two serially filed unlawful detainer actions.

Collection of fees award in pursuit of action against insider embezzler.

Conducted eight-day jury trial in pursuit of claim for wrongful retaliation in termination of employment.

Successfully closed probate estate involving sale of real property and pour-over of assets from a second estate.

Successfully defended member of board of directors who allegedly diverted homeowners’ association assets.

We currently have 11 patent applications pending review at the USPTO, in addition to maintenance obligations and prosecution of trademarks.

Raquel Flyer Dachner was elected President of the South Orange County Bar Association which meets monthly at Hotel Laguna.
